The course is composed of two modules.
First Module (40 hours) : analysis of the nature, goals and functions of the
comparative methodology, legal families and legal systems, competition
and circulation of legal models. Main features of the legal systems
belonging to the western legal tradition, that is France and Germany (as
for the civil law systems); United Kingdom and United States, as for the
common law systems. The following topics shall be faced: historical
origins of the two opposite legal systems; administration of justice; legal
method and precedent; the sources of the law; codification; the role of
judges.
Second Module (20 hours): Contract in civil law and common law
systems; European contract law: historical origins of the cause of actions,
formation, contents, legal effects, invalidity, contractual
liability, frustration and breach
