PURPOSE OF THE COURSE:
The course aims at the analysis of the system of legal sources and of their historical development in the frame of the institutional experiences of the European countries. The main topic focuses on the role of the jurist and on the instruments, methods and techniques employed by him the building of European Law from the XII until the XX century. The course makes use also of direct knowledge of the sources, using the on-line data base, accessible with the knowledge of the contents of the didactical support under n. 4) of the following list of texts.
PROGRAM OF THE COURSE
I°. From the Regulae iuris to the general principles of Law
- Law and organization of the society in the middle-age and in the modern age
- The source of Law and the role of jurist in the common legal system
- Legislator and interpreter in the age of modern doctrine of natural law
II°. The paradigm of modern state
- The system of the source in the age of codifications
- Jurists, legislators, judges, interpreters: the roles and legal functions of contemporary age

During the course tree written tests are expected, open both to attending and un-attending students: the first one, expected approximately within the first fiftheen days from the beginning of the course, will focus on the knowledge of the text Paul Ricoeur, L’Europa e la sua memoria, (Europe and its memory, Brescia, Morcelliana, 2017. The two subsequent tests will focus on the remaining part of the program, as per a regulation designed for them.
The results of the tests, expressed in thirtieths, will be valid for the whole academic year.
The regulation of the written tests, containing among others, timing and modalities of the tests, will be timely published during the performance of the course.
