The course proposes an illustration of what contributes the canonical law, the juridical open mentality and the analysis of confessional law-that of the Catholic Church-as seen in a contemporary jurist.
The course will offer the foundation knowledge of canonical law as by the original juridical system.
Consequently, it will be formulated as follows:
• The Church and its laws: Divine law and Human law; unity and pluralism; universal law and particular law
• History’s canonical law: From Corpus to Codex; codification process and its fruits.
• The source of the law and the resources of codified systems: Laws, customs, supplementary laws, single administrative acts; sampling of canonical regulations drawn from prepared work of the twentieth century regulations.
• Government structure: the hierarchical structure of the Church; ecclesiastical offices, the papal leader; central government authority; episcopal association; the leader and collegiality; the combined practice of Episcopal ministers; the particular government of the Church.
• Faith status, laic, cleric, devout, associations and ecclesiastical movements, juridical people
In the different treated areas, following the reformed teachings of the study of fundamental institutes in the latin law, it is intended that we recognize the constant osmotic process between the divine law and the human law .It is from there that the juridical life of the people of God and the hierarchy of the Church, inspires the dynamicity of the original source. In this light special attention is paid to the fundamental categories of canonical laws, amongst those, the aequitas canonical and the rationabilitas.
