The content of the course will be the analysis of the various defensive techniques, with reference to the different juridical goods. A special attention will be reserved to the examination of tributary criminal law, bankruptcy criminal law and individual types of offence chosen among corporate crimes and new legislative features (for example, the crime of self-laundering).
Subject of specific analysis will ben the types of offence that characterize the various kinds and forms of liability (commission or omission) and the criteria of its attribution (malice or negligence).
Caution: in order to attend the classes it is necessary to have an updated Criminal Code and Criminal Code of Procedure, up-to-date with the regulation, which is subject of this course. We suggest “Fiandaca-Giarda, Codice Penale e Codice di Procedura Penale”, latter edition, Ipsoa, or “Alibrandi-Corso, Codice Penale e Codice di Procedura Penale e leggi complementari”, latter edition, La Tribuna.
The course for attending students consists of the analysis of the type of offence, as a starting point for the complete examination of criminal law and as application of the dogmatic principles learnt in the general part.
an up-to-date Criminal Code that relates in the appendix also the relevant special regulation (Legislative Decree n. 231/2001 and subsequent updates, corporate crimes, bankruptcy crimes, tributary crimes). For attending students, integrative material will be provided and there will be the indication of the parts of the text to study. For non-attending students (beside the fundamental Criminal Code above indicated) the texts will be indicated among the most updated ones, in the light of the current legislative changes.
